The Two Rules That Decide Every NRI Marriage Plan

Before any of the detail, two facts. Almost every NRI marriage that goes wrong goes wrong because somebody did not know one of them.

Rule one: both of you must be physically present. There is no power-of-attorney marriage in India, no proxy marriage and no video-call marriage. A relative cannot stand in for the partner who is abroad, however senior, however willing and however much has already been spent on the hall. Anybody offering you a “proxy nikah”, a “PoA marriage” or a certificate issued while one party is in Toronto is selling you a document that will fail its first serious check — and the check it fails will be a visa interview.

Rule two: plan backwards from the departure date, not forwards from the wedding date. The wedding is the short part. The government certificate, the apostille or attestation, and the embassy’s own timeline are the long part, and they all happen after the ceremony. A couple who books a two-week trip around a one-day wedding almost always goes home without the paper they actually came for.

The honest summary for most couples on a three-week visit: if both of you are Hindu, Sikh, Jain or Buddhist, the Arya Samaj route with registration is the one that actually fits, and it is not a lesser marriage — it is a Hindu marriage under section 7 of the Hindu Marriage Act, with the registration under section 8 that every embassy acts on. If you are of different faiths and neither will convert, the Special Marriage Act is the correct route and it needs about sixty days with thirty of them as residence before notice is even given — which means, bluntly, that it does not fit a two-week trip and you should plan a different visit rather than let anybody tell you it can be rushed.

Nobody can shorten the Special Marriage Act’s thirty-day notice. Not for a fee, not through a contact, not because a visa expires. The period is in the statute. If an agent tells you they can, what they are actually proposing is a false residence claim or a false document, and a false statement on a marriage record is discovered at precisely the counter you cannot afford to fail — the visa interview.

If You Are Already Married Abroad

A very common and very misunderstood situation, so here it is plainly.

A marriage validly celebrated abroad is generally recognised in India, according to the law of the place where it was celebrated and subject to the usual requirements of capacity and consent. You do not normally “re-marry” in India, and you should be extremely careful of anybody who suggests you do — a second ceremony while a first marriage subsists is not a formality, it is a serious problem.

What you usually need instead is your foreign marriage certificate made usable in India: apostilled or attested in the country that issued it, and translated into English by a recognised translator where it is in another language. That is done at that end, not this one. Indian authorities that then need it — a bank, an insurer, a passport office adding spouse particulars — act on that document.

Where an Indian mission solemnised or registered the marriage under the Foreign Marriage Act, 1969, the certificate comes from the mission and its own procedure applies.

What we will not do: arrange a second Indian wedding for a couple already married abroad in order to produce an Indian certificate, or register in India a marriage we can see took place elsewhere in a way the file does not disclose. One marriage, one record. Two records of the same marriage in two countries is the discrepancy that stops a visa, a green card or an OCI application, and unwinding it is far harder than getting it right once.

The Apostille and Attestation Chain, Step by Step

This is the part that takes the time, and almost nobody plans for it. Work through it in order.

  1. The government marriage certificate. Issued after registration by the SDM or the Registrar of Marriages through Delhi e-District. A mandir certificate is not this document, and no foreign authority will act on one. Everything below starts here.
  2. Authentication within India. Before the Ministry of External Affairs will apostille or attest a document, it ordinarily has to be authenticated by the designated authority of the state or union territory that issued it — in practice the Home Department, the General Administration Department or an authorised SDM, depending on the state and the document.
  3. MEA apostille, or MEA attestation. The Ministry of External Affairs apostilles documents for countries that are party to the Hague Apostille Convention, and attests them for countries that are not. In practice the work is handled through the Ministry’s outsourced centres and Branch Secretariats rather than over a counter in South Block.
  4. Embassy attestation, for non-Hague countries only. Where the destination country is not party to the Convention, the document additionally goes to that country’s embassy or consulate in India for attestation after the MEA stage.
  5. Translation, where needed, by a recognised translator, with the names spelled exactly as they appear on the passport.

Ask the receiving authority which one it wants, before you order anything. Apostille and embassy attestation are different things, the list of Hague members changes — Saudi Arabia joined in 2022 and Canada in 2024, for instance — and requirements differ between a visa section, a university, an employer and a court in the same country. Ordering the wrong one costs you two or three weeks and a second courier. Confirm the current position with the mission or on the MEA’s own site; do not rely on any website, including this one.

A realistic budget of time for the whole chain, after the wedding: a few working days for the registration, then commonly one to three weeks for authentication and apostille, and a further one to three weeks where an embassy attestation is also needed. Missions and centres have their own queues, and they are the part nobody controls. We will never quote you a guaranteed date for a step that belongs to a government office or a foreign mission, and anybody who does is guessing with your ticket.

Visas, OCI and What Comes After the Certificate

We are a marriage documentation service. We do not file visa applications, we are not immigration consultants, and we take no share of anybody’s fee for that work. What follows is the shape of the thing, so that you plan around it rather than being surprised by it — every detail is decided by the mission or authority concerned, and their published requirements govern.

And the passport point everybody forgets: adding a spouse’s name to an Indian passport, or changing your own name after marriage, is a re-issue — which means a new passport number. If a visa or a travel booking is tied to the old number, sequence it deliberately rather than doing it in the same week you fly. And note that no law requires anybody to change their surname; if you choose to, the order is affidavit, newspaper notices, Gazette of India, then Aadhaar, PAN, bank KYC, employer, and the passport last.

Name and Spelling Mismatches: The Quiet File-Killer

On an NRI file this is not a small problem, it is the problem.

Your Indian documents were created over twenty years by different clerks. Your passport was created once, carefully, and the foreign authority treats it as the truth. So the marriage certificate says “Sunita Devi”, the Aadhaar says “Sunita Rani”, the passport says “Sunita”, and the visa section has to resolve a question you could have resolved in a week for ₹2,500.

Verifying Who You Are Marrying — and the Help That Exists If It Goes Wrong

We would rather lose a booking than write this page without this section. Cross-border matches are the ones most often built on something untrue, and the person who pays for it is almost always the woman who stays in India.

Before the wedding, verify independently — not through the broker who introduced you:

Never do these, whoever asks: hand over the bride’s passport or original documents to the groom’s family; pay dowry or a “settlement” through an agent; sign blank papers or blank stamp paper; or let the marriage be registered in a way the bride has not read and understood. And keep a complete copy of every document and every photograph in the bride’s own possession and in her own email.

Read the tiers honestly before you choose one. The ₹5,100 line is the ceremony only — it does not include the government registration, and an overseas authority will not act on a mandir certificate. If your reason for marrying in India is a visa, an OCI application or anything that will be read abroad, you need registration at minimum, and apostille or attestation on top.

Government charges and third-party charges are separate and shown at cost on your receipt, on their own line, with our charge on another — that includes MEA and embassy fees, courier and translation. What “tatkal” can and cannot buy. It can buy priority handling and a faster appointment on a registration where that facility is available. It cannot shorten the Special Marriage Act’s thirty-day notice, and it cannot make a foreign mission move faster. Those two are outside anybody’s control, including ours, and a service that implies otherwise is selling you certainty it does not have.

Twelve Mistakes NRI Couples Make

  1. Booking a two-week trip for a sixty-day route. If you are an inter-faith couple and neither will convert, the Special Marriage Act needs thirty days’ residence before notice is even given. Plan a different visit.
  2. Stopping at the mandir certificate. No embassy, university, employer or immigration authority anywhere acts on it.
  3. Leaving the no-impediment certificate to the last week. It is the slowest item and the embassy sets the pace.
  4. Ordering the wrong authentication — an apostille where attestation was needed, or the reverse. Ask the receiving authority first.
  5. A name spelled differently on the certificate and the passport.
  6. Ordering one certified copy. Get several while you are in India.
  7. Changing a name and a passport in the same week as flying. A name change is a re-issue and the passport number changes.
  8. Registering the same marriage in two countries “to be safe”. It is the discrepancy that stops a visa.
  9. Getting foreign documents attested in India instead of in the country that issued them.
  10. Handing original documents to an agent, a broker or the other family.
  11. Believing an agent who promises a certificate while one party is abroad. There is no proxy marriage in India.
  12. Never updating the nominations. EPF, gratuity, insurance and bank nominations do not carry over on marriage, and a nominee is in any case a receiver, not an owner.

Four NRI Situations, and What Happened

Anonymised, and each stands for many.

The couple who planned backwards. He flew from Melbourne with three weeks. They sent documents six weeks ahead, started the Australian high commission’s no-impediment certificate immediately, married in the first week and registered in the second, and ordered four certified copies before he flew. The apostille finished after he had gone and was couriered. Nothing dramatic happened, which was the point.

The one-week trip that failed. An inter-faith couple arrived with eight days and were told by an agent that the Special Marriage Act could be “managed”. It cannot. Thirty days’ residence, then thirty days’ notice, and no fee shortens either. They lost a trip and the agent’s deposit. They came back four months later and did it properly.

The certificate nobody would accept. Married at a mandir in 2019 on a holiday, certificate in a drawer, no registration. Five years later an OCI application on the basis of marriage needed a registered marriage subsisting for the prescribed period. The marriage was real and the years were real; the record was not there. We registered it as an existing marriage — but the clock for the OCI requirement is a question for the authority, not for us, and that is a conversation nobody wants to have five years late.

The one we refused. A family asked whether the groom’s brother could stand in, as the groom’s leave had been cancelled. No. There is no proxy marriage in India, and a certificate produced that way is a document that will be examined by exactly the authority most able to detect it. They rebooked.

What We Will Not Do

Two safety notes. Never hand original documents to somebody who approaches you outside a mandir, a court or an office, and never sign a blank form or blank stamp paper. And nobody from us will ever ask you for an OTP, a UPI PIN, a card PIN, a CVV or a net banking password, or ask you to install a screen-sharing app, or ask you to approve a payment request in order to receive money. Couples sending money from abroad for a wedding are a favourite target. That does not fit two weeks and nobody can make it fit. Plan a longer visit rather than letting an agent tell you it can be rushed.
Do we need to have lived in India to marry here?▼
Not for the Arya Samaj route. Delhi's rules under section 8 of the Hindu Marriage Act allow registration by the Registrar in whose jurisdiction the marriage was solemnised, as well as where a party resides — which is exactly why this route works for visitors. The Special Marriage Act is different: at least one party must have resided in the district for thirty days before the notice, and a hotel stay is not residence.
Can the 30-day notice be shortened for a visa deadline?▼
No. The period is in the statute and nothing lawfully shortens it — not a fee, not a contact, not an expiring visa, not a medical reason. If your reason for marrying in India is anything that will be read abroad, registration is the minimum and apostille or attestation usually sits on top.
What is the apostille chain, step by step?▼
First the government marriage certificate after registration. Apostille or embassy attestation — which do we need?▼
It depends on the destination country, and you should ask the receiving authority before ordering anything. Countries party to the Hague Apostille Convention take an apostille; those that are not need embassy attestation after the MEA stage. The membership list changes — Saudi Arabia joined in 2022 and Canada in 2024, for instance — and requirements can differ between a visa section, a university, an employer and a court in the same country. Where do we get our foreign documents attested?▼
In the country that issued them, before you travel. A birth certificate, a divorce decree or a single-status document from abroad is apostilled or attested at that end — not in India. This is one of the commonest reasons an NRI file stalls: the couple arrives with foreign documents that nobody in India can authenticate.
What is a no-impediment certificate and where do we get it?▼
A certificate of no objection to marriage, issued by the foreign national's own embassy or high commission in India, confirming there is no impediment to their marrying. Each mission has its own form, fee and timeline and some take several weeks, so start it six to eight weeks before you fly. Start with the embassy, not with us — it is the slowest item in the whole plan and it sets the pace of everything else.
What does OCI need?▼
For an application based on marriage, the marriage must be registered and subsisting for the period prescribed — commonly stated as two years — before the application. The authority decides, and its published requirements govern. This is the single most-cited reason we are told registration matters, and it is why stopping at a mandir certificate is so costly: couples discover five years later that the marriage was real but the record was never created.

No. We are a marriage documentation service, not immigration consultants. We do not file visa, OCI, spousal sponsorship or fiancé(e) applications, and we take no share of anybody's fee for them. What we do is produce the marriage documentation those applications are built on, correctly and in the right order, and tell you honestly what the sequence looks like so you plan around it.
Which route is right if one of us is not Hindu?▼
If neither of you will convert, the Special Marriage Act — it needs no conversion by anybody, takes about sixty days including the thirty days' residence before notice, and costs ₹15,000. Please do not convert in order to make a wedding fit a trip: several Indian states now have laws on religious conversion, some requiring a prior declaration to the District Magistrate and some treating conversion solely for the purpose of marriage as unlawful, with consequences that can reach the people who arranged it. Take proper legal advice for the state you actually live in before anybody converts.
How many witnesses do we need, and can you arrange them?▼
Two for an Arya Samaj ceremony, three for a Special Marriage Act solemnisation. Each must be an adult who genuinely knows you, carrying their own original photo identity and address proof, attending in person. We do not provide witnesses — not for a fee, not as a favour, and not because you have flown in and know nobody. On a file a visa section will examine, a paid witness is not a shortcut; it is a weakness you have built in deliberately. Ask two people a week in advance and confirm the night before.
Our names are spelled differently on the passport and the Indian documents. Does it matter?▼
On an NRI file it is not a small problem, it is the problem. Decide before the wedding which spelling is correct — for an NRI file that is almost always the passport — and tell us before the certificate is prepared. Getting it right on the day costs nothing; correcting it from Toronto costs an application, a ₹2,500 fee and somebody's trip. Where an older Indian document cannot be corrected, a “one and the same person” affidavit is the usual instrument.
How many certified copies should we order?▼
Several, while you are still in India — one for the mission, one for the apostille chain and one for your own file at minimum. Obtaining another copy from abroad is the slowest thing in this entire process. Ask the authority that wants it which form it needs — plain, self-attested, notarised, office-certified or apostilled — before you order.
What must we check before leaving the registration counter?▼
Both names and their exact spellings against both passports, both fathers' names, the date, the place, and both dates of birth. A correction made on the spot takes a minute. Everything downstream — apostille, embassy attestation, the visa file — is built on this one document, so a mistake here propagates through every step.
Will changing my name after marriage affect my passport?▼
Yes, and plan it deliberately. Adding a spouse's name to an Indian passport, or changing your own name, is a re-issue — which means a new passport number. If a visa or a booking is tied to the old number, do not do it in the same week you fly. And note that no law requires anybody to change their surname; if you choose to, the order is affidavit, newspaper notices, Gazette of India, then Aadhaar, PAN, bank KYC, employer, and the passport last.
What documents does the foreign partner need?▼
Passport, and a valid visa with evidence of lawful stay covering the whole period — including the paperwork days after the wedding, not just the wedding day. A birth certificate or equivalent age proof, apostilled or attested in the issuing country. A no-impediment certificate from their embassy in India. A divorce decree or death certificate where they were married before, again apostilled or attested and translated. And passport photographs.
What documents does the India-based partner need?▼
Age proof — matriculation certificate, birth certificate or passport, and this is the item most often sitting in a trunk in another state, so start it first and courier it rather than travelling for it. Photo identity and address proof in original; a home-state address is perfectly valid. Passport photographs. And a divorce decree or death certificate where previously married.
Can we do everything in one trip?▼
The marriage and the registration, usually yes, if you have planned ahead. The apostille and any embassy attestation often finish after you have flown, which is fine — they can be couriered. What must happen while you are both here is the ceremony, the registration appointment, the counter check and the ordering of certified copies. Build the trip around those, not around the wedding alone.
What is the realistic timeline from the first message?▼
Six to eight weeks before you fly: send documents, we confirm the route, you start the embassy's no-impediment certificate and the age proof. Four weeks before: foreign documents apostilled and translated at that end, witnesses confirmed. Two weeks before: the exact spelling of both names fixed. Day 1 in India: documents checked in person. Day 2–3: ceremony and mandir certificate. The following working days: registration and the government certificate. Then two to six weeks for authentication, apostille and any embassy attestation.
What is the difference between the ₹5,100 and the higher tiers?▼
₹5,100 is the ceremony only — pandit, havan, saptapadi and the mandir certificate. It does not include the government registration, and no overseas authority acts on a mandir certificate. ₹6,100 is court marriage assistance. ₹20,000 covers the marriage, registration and the apostille chain; ₹30,000 adds embassy attestation for non-Hague countries; ₹35,000 is tatkal priority handling. Ask which tier you are buying and check it on your receipt before you pay.
What can tatkal actually buy?▼
Priority handling and a faster appointment on a registration where that facility is available. It cannot shorten the Special Marriage Act's thirty-day notice, and it cannot make a foreign mission or the MEA move faster. Those are outside anybody's control, including ours, and a service that implies otherwise is selling certainty it does not have.
Are government and embassy fees included in your fee?▼
No. Government and third-party charges — MEA and embassy fees, courier, translation — are separate and shown at cost on your receipt, on their own line with our charge on another. We add nothing to them and round nothing up. If your receipt does not let you see where every rupee went, tell us and we will rewrite it.
Do you charge more because a visa interview is dated?▼
No, never — not for urgency, distance, a weekend or a deadline. If somebody in this trade quotes a higher figure because you sound pressed or because you are calling from abroad, that tells you everything about them.
How should we verify who our daughter is marrying?▼
Independently, and not through the broker who introduced you. See the passport and the actual visa or residence document, not a photocopy of a PR card. See a divorce decree in original or certified copy with the case details legible, apostilled if the divorce was abroad — not an assurance and not an affidavit. See an employer letter, a payslip, a utility bill or a lease, and verify one of them yourself. And treat a match arranged entirely through an agent, where the two families have never met in person, as the pattern that most often goes wrong.
What should a bride never do in an NRI marriage?▼
Never hand over her passport or original documents to the groom's family. Never let dowry or a “settlement” be paid through an agent. Never sign blank papers or blank stamp paper. Never let a marriage be registered on terms she has not read and understood. And keep a complete copy of every document and photograph in her own possession and her own email account.
What help exists if an NRI spouse deserts his wife?▼
More than most people know. The Ministry of External Affairs runs a scheme, funded through the Indian Community Welfare Fund, giving legal and financial assistance to Indian women deserted by their overseas Indian spouses, delivered through Indian missions with empanelled lawyers and NGOs — approach the Indian mission in the country concerned, or the MEA. The National Commission for Women has an NRI cell that takes such complaints. Within India the ordinary remedies — maintenance, a residence order under the Protection of Women from Domestic Violence Act 2005, custody — are available and are an advocate's work. And a registered marriage is what makes every one of those usable: a woman with only a mandir certificate spends her first six months proving she was married at all.
Can we register the marriage both in India and abroad?▼
No, and it is the opposite of safe. One marriage, one record. Two registrations of the same marriage in two countries create exactly the discrepancy that stops a visa, a permanent residence application or an OCI application, and unwinding it is far harder than getting it right once.
Is an Indian marriage certificate valid in our country?▼
A government certificate issued after registration, properly apostilled or attested for the destination, is what foreign authorities act on. A marriage registered in India is valid throughout India, and the apostille or attestation is what carries it across the border. What no foreign authority will accept on its own is a mandir certificate.
What if one of us is not sure about the marriage?▼
We stop. A marriage requires the free consent of both adults — not of a family, not of whoever arranged the match, and not the silence of somebody brought along and told to nod. We speak to both parties separately, in a language each is comfortable in, and if somebody is answering on another's behalf we ask them to step outside. A bride who is not permitted to answer for herself is the situation we watch for hardest on cross-border files. If you are the person who is unsure, ask to speak to us alone; you will not be argued with and nothing will be told to the people waiting.
Can you register the marriage if the bride is 17?▼
No. Under the Prohibition of Child Marriage Act, 2006 the minimum age is 21 for the groom and 18 for the bride. We decline in every case, at any price, whoever is asking and wherever they are flying in from, and we also decline where a document appears to have been altered.
One of us was married before, abroad. What do you need?▼
The decree, in original or certified copy with the case details legible, apostilled or attested in the country that issued it and translated into English where needed. Not an affidavit saying the marriage “is finished”. And we will not marry anybody while an earlier marriage subsists, here or abroad — a second marriage during the subsistence of a first is void for those governed by the Hindu Marriage Act and it is an offence.
What should we do after we get the certificate?▼
Order several certified copies while you are still in India; start the authentication and apostille chain; check the certificate against both passports one more time; and then update every nomination — EPF, gratuity, insurance, bank accounts — because they do not carry over on marriage, and a nominee is in any case a receiver, not an owner. Then Aadhaar and bank KYC, employer records, and the passport re-issue if a name is changing.
Will you ask us for an OTP or a UPI PIN?▼
Never. Nobody from us is authorised to ask for an OTP, a UPI PIN, a card PIN, a CVV or a net banking password, and we will never ask you to install a screen-sharing app or approve a payment request in order to receive money — an approved request is money leaving your account. Couples sending money from abroad for a wedding are a favourite target. Get a receipt for every rupee, never hand originals to anybody who approaches you, and never sign a blank form.
